    Parking Regulations

    (Summary of Willmar City Ordinances Chapter 15)

     

     

 
 

General Parking Information:

 

(1)   No vehicle of any kind shall be stopped, parked or left standing with its left side to the curb, except as otherwise provided in this section.

(2)   Unless otherwise modified or determined by the city council as provided in subsection (b) of this section, when any vehicle is to be left standing or parked at the curb on any street, avenue or public place within the city, it shall be left standing or parked within one (1) foot of and parallel to the right-hand curb, but not nearer than three (3) feet from any other vehicles; provided, however, that on all one-way streets, all cars shall be parked facing in the direction of the flow of traffic and parallel to either the right- or left-hand curb, depending on the side of the one-way street upon which the automobile is parked.


Double-parking.

No vehicle of any kind shall be left standing or double-parked at any time or place, except that vehicles may be double-parked for the purpose of taking on or discharging passengers, only for a sufficient length of time to enable the passengers to enter or to remove themselves from the vehicle, after which the vehicle shall immediately proceed.

 


Parking for more than forty-eight hours prohibited; removal of vehicle.

No vehicle, including service trailers, shall be parked or left standing at the curb on any street or avenue or any public place in the city for more than forty-eight (48) hours at any one (1) time. In any case of parking of a vehicle for more than forty-eight (48) hours, any police officer of the city is authorized and empowered to remove the vehicle from the street, avenue or public place where parked and to safely keep the vehicle until the owner or person in charge of the vehicle calls for the vehicle.


Places where parking prohibited.

No person shall park a vehicle or permit it to stand, whether attended or unattended, upon any highway within the city, in any of the following places:

(1)   On a sidewalk.

(2)   In front of a public or private driveway.

(3)   Within an intersection.

(4)   Within fifteen (15) feet of a fire hydrant.

(5)   On a crosswalk.

(6)   Within twenty (20) feet of a crosswalk at an intersection.

(7)   Within thirty (30) feet of any flashing beacon, stop sign, or traffic-control signal located at the side of a roadway.

(8)   Between a safety zone and the adjacent curb or within thirty (30) feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings.

(9)   Within fifty (50) feet of the nearest rail of a railroad crossing.

(10)   Within twenty (20) feet of the driveway entrance to any fire station and, on the side of a street opposite the entrance to any fire station, within seventy-five (75) feet of the entrance, when properly signposted.

(11)   Alongside or opposite any street excavation or obstruction, when such stopping, standing or parking would obstruct traffic.

(12)   On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

(13)   Upon any bridge or other elevated structure upon a highway, except as otherwise provided by the council by resolution.

(14)   At any place where official signs prohibit stopping.

Painting of curbs.

It shall be unlawful for any person to park any vehicle in the painted zone and alongside thereof at any time; provided, however, that signs, either vertical in type or painted upon the curb portion, may and shall otherwise indicate the type of parking permissible alongside the painted curb area.



 Truck parking.

No trucks classified as one-ton vehicles or over, semitrailers or tractors, unattached camping or house trailers, implement trailers, or similar vehicles shall be permitted to park on any public street, thoroughfare, public alley, parking lot or public property for a period longer than two (2) hours, except where such vehicle is parked on a street or thoroughfare on which the adjacent property on both sides of the street or thoroughfare is zoned for light industry (LI) or heavy industry (HI). This restriction shall not apply to vehicles actually engaged in moving household furniture or furnishings, small delivery trucks, service trucks, or service trailers, however, each vehicle or trailer exempted in this section shall be subject to section 15-50.

 


Service parking.

 Persons eligible for permit; application.   Any person engaged in a service trade, such as plumbing, electrical work, telephone repair, maintenance and installation, gas repair, installation and service, and allied and similar service trades, may apply to the chief of police on forms furnished by the city for such service parking privilege. The application shall be accompanied by a fee in an amount as kept on file at the office of the city clerk-treasurer.  See city Ordinances for more information.

 


Parking vehicle for purpose of sale.

No vehicle shall be parked on any street for the purpose of displaying it for sale.

 


Parking house trailer for camping purposes.

No person shall, for camping purposes, leave or park a house trailer on any street or the right-of-way thereof.

 

 

 

 

Penalties for parking violations.

(1)   Parking over time limit (less than 1 hour over) . . . $ 5.00

(2)   Parking over time limit (more than 1 hour over, but less than 2 hours over) . . . 10.00

(3)   Parking over time limit (more than 2 hours over) . . . 15.00

(4)   Parking in yellow zone . . . 10.00

(5)   Parking on crosswalk . . . 10.00

(6)   Blocking driveway . . . 10.00

(7)   Double-parking . . . 3.00

(8)   Improper parking . . . 5.00

(9)   Parking too close to fire hydrant . . . 10.00

(10)   Parking on wrong side of street . . . 5.00

(11)   Parking where official signs prohibit . . . 5.00

(12)   Parking over 48 hours . . . 20.00

(13)   Parking in established fire lane . . . 5.00

(14)   Parking where or when official signs prohibit in off-street parking lot, except 15-minute zones . . . 2.00

(15)   Parking overtime in 15-minute maximum parking zone . . . 5.00

(b)   Time for payment.  The owner, driver, operator or person in charge of any vehicle that receives a ticket for any of the violations listed in subsection (a) of this section, except subsection (a)(13), shall have forty-eight (48) hours from the time of issuance of the ticket to pay the penalty. Failure to pay the penalty within the forty-eight-hour period shall be a misdemeanor. Failure to pay the penalty under subsection (a)(13) within seven (7) days of the time of issuance of the ticket shall be a misdemeanor. The fine for any violation not paid within thirty (30) days of issuance of the violation shall be doubled. 

 

 


Snow emergencies.

 

Declaration of emergency.  A period of snow emergency shall be declared by the public works superintendent or the superintendent's designee and shall take effect no earlier than four (4) hours after such declaration. A declaration of snow emergency shall be publicized by news media announcements during such four-hour period.

 

  Parking, towing of vehicles.   

(1)   No person shall park or leave a motor vehicle or trailer on the streets, highways, or alleys within the city during a declared period of snow emergency, or until snow maintenance operations have been fully completed, curb to curb, on the streets, highways, or alleys to be used. (The snow emergency streets usually include  the "downtown business district" which means the area of the city bounded by the following streets: Trott Avenue on the south; Seventh Street Southwest on the west; Highway 12 bypass and Pacific Avenue on the north; and Highway 71 (First Street) on the east.)

 

(2)   No person shall park or leave a motor vehicle or trailer upon any public street, highway, alley or public parking lot within the city within any block or area which has been signed or posted with either permanent or temporary signs restricting, regulating or prohibiting parking in the area or street.

 

(3)   The public works superintendent or the superintendent's designee shall have the authority to remove or cause to be removed any motor vehicle or trailer parked during a period of declared snow emergency in violation of this section. Such removal shall be to city parking facilities, and shall be at the owner's expense. The cost of the removal shall be assessed in addition to any fines or other penalties imposed by this section.

 

 

Placing snow from private property on street, public property.  No person shall place or cause to be placed any snow from private property onto any public property, including streets, highways, alleys, boulevards, medians, sidewalks, parking lots, parks or any other public property or part thereof, during a declared snow emergency, unless authorized by the city engineer. 

 


Parking in the Business District

 

the "downtown business district" which means the area of the city bounded by the following streets: Trott Avenue on the south; Seventh Street Southwest on the west; Highway 12 bypass and Pacific Avenue on the north; and Highway 71 (First Street) on the east.)

 


 Penalties for violation of division.

The owner, driver, operator or person in charge of any vehicle parked in any off-street parking area or on-street parking area regulated by this division shall conform to and abide by the parking limitations established for each on-street and off-street parking space. The penalty for parking beyond the time limit established  shall be two dollars ($2.00) if the penalty is paid within seventy-two (72) hours of the time of issuance of the notice of violation. All violations not paid within seventy-two (72) hours shall be misdemeanors.

 


Same--Days and hours of enforcement.

The police department shall enforce the time limitations established pursuant to this division on Monday through Saturday, inclusive, from the hours of 9:00 a.m. to 5:00 p.m. Enforcement shall also be provided on all holidays, except those holidays during which retail businesses are closed.

 


 Parking of vehicle within same block.

(a)   No person shall park his vehicle within the same block on any street for more than the posted time limit during any one (1) time period, between the hours of 9:00 a.m. to 5:00 p.m. of days for which enforcement of the parking time limitation is required.
